Lovely police state we live in, eh? Maybe these officers never heard of the 4th amendment...

Nice. You didn't get the memo? The Constitution is obsolete now. We only hve the rights they decide to "allow" us. Thank you Patriot act.
 
I still hold to my original statement, but there's a point when you concede and pursue any violations in a court of law later. The dogs provided probable cause. He did have a right to ask what he was charged with and to refuse search verbally, but to refuse to get out of the car when given probable cause is just beggin' for a butt whoopin'. Choose your battles, and not at a national BORDER of all places.
I still think the tazer was absolutely unnecessary, especially after so many deaths related to them. Why 6 cops with dogs are afraid of a stringy little white guy enough to taze him is beyond me. There's a word for people like that and it starts with P. I know here in Portland they recieve 10 weeks of firearms and tazer training and only 2 weeks of physical self defense training. i guess when in doubt, go with what your most familiar with:|.

He was not at the border. He was inside the border on interstate 8 about 70 miles from a border crossing. The gestapo patrol runs a dog by every car that drives on interstate 8. Every car runs through the checkpoint and if the dog barks, if they say the dogs barks even if the dog does nothing they claim to have the right to search your car. I will not let them. When the DPS officer showed up he should have complied, but its crap that it gets that far. The sheeple are willing to give up freedom for fake numbers inflated by the fact that they cannot do the job they are hired for. Protecting the border. If you were to check every single person that you see in a day you would be bound to find something. Thats why they can produce numbers that appear to be better than before. I would rather they had sharks with lasers and robot machine gun turrets kill anything that crosses the border illegally before they search my truck for no reason.

My guess would be none.

Good luck with that lawsuit. The Patriot Act gives police the right to club you like a baby seal if you ask one for directions, make eye contact or fart in their general direction.

And even if it doesn't give them that right, they take it anyway.

It's hard to argue with a guy with a gun, impossible when he has a badge too.

Usually people who don't have anything to hide will just let the officers take a quick look and then you will be on your way.

I go to Canada twice a year for a lot of years and my grandfather and father have been going up since the 60s. My grandfather was searched twice going into Canada in all those years and I was searched once going back into the US.(Post 9/11) Can you imagine what would have happened if I would have resisted the search? All three of us went in the building while a hot ass border officer lady took a quick look in my truck. She gave me my keys back said "Nice Truck" and we were on our way. A random search and I had nothing to hide. They were just doing there job. It was an inconvience to me but not much I could do about it.

Exactly. Same thing when you are in the airport.

I was asked to have my bags searched when leaving Heathrow and I kindly agreed. At the same time, a lady was asked to have her bags searched and she was bitching and moaning about the process. When the officials were finished, they took me to the front of the line....they took the lady to the back.
 
You were crossing the border. This guy was not. His reason for arrest was disobeying, even though they had no warrant and would not reproduce probable cause.


Those officers didn't handle that the best way. They could have just yanked him from the car, he was obviously not a threat to their safety.
 
He was crossing the Arizona/Cali border and if you get on an airplane even if flying from state to state they will be interested in whats in your carry on bags. Sometimems in life you got to do things you don't want to do because you have to and its just easier to go along and keep your mouth shut. You start whining like a bitch and resisting law enforcement (whether the cops were right or not) and you'll run into trouble and a lot of your time will be wasted. You just have to be smart enough to pick your battles and think about what the outcome will be from the action you take.

There's a difference between being OK with it and going along with it. On the side of the road is not the place to argue with police or create a problem. When pulled over, I comply with everything an officer requests, even if I think he's in the wrong. If I believe he is in the wrong, then I'll take it up in court. This method has work well for 31 years....I've experienced no beatings thus far.
 
Thats crazy.

The guy was in the right by not complying initially, but should have backed down once the DPS officer arrived and they were preparing to forcefully enter his vehicle.

I can see how the BP and DPS officers would be highly suspicious of someone refusing to have thier car searched, but really, two broken windows and two stun guns? Very excessive. If the DPS officer had drawn his weapon and tapped it on the guys window, I'd bet he would have been out of his car in a flash. They then could have detained him while they searched his car. What they did do was nothing more than childish bullying.
 
I'm not saying the pastor couldn't have handled the situation better too. Getting out of his car would have been a good choice, even if he still refused search.
