ebay Deal Gone Bad: Possible Recourse?

Sucks to hear Tommy. I think fake keywords are pretty common on e-bay, so are obviously allowed. Especially if it didn't say in the description that it had the tuning kit, I can see why e-bay sided with the seller.

Now, the titanium turnbuckles are a different issue. You plainly got hosed on those parts. I'm guessing though that e-bay saw your positive feedback, and the delay in filing a complaint, and guessed that you just weren't satisfied with it for other reasons and are just trying to get some money back.

Sucks for sure. Post up the sellers name so we can avoid him and send him gay porn subscriptions :twisted:

But yeah, I think you're 100% correct in your assumptions. Never again will I put so much good faith in the intentions of those whom I don't know. That was naive of me, plain and simple. And believe me, it will not happen again. :evil:

ive always had great luck with PP/ebay claims. but i had never given prior feedback either. i hope you can get something out of it.
 
Just keep moving down the line. PayPal next. I feel like at this point its not about 30 bucks. Its about the seller pulling a fast one on you. Even if you are not winning your claims you sticking a thorn in his foot when he has to attempt to justify fraud.
 
Would providing feedback have any bearing on a dispute as far as paypal is concerned? 'Cause I definitely feel that's what hurt me with regard to ebay.
 
I didn't spot a link to the original auction, so I cannot comment on the context of the description or wording. Just judging by the description that you posted however, the term "TLR kit" does not specifically mean the tuning kit. TLR can mean the name of the manufacturer, Team Losi Racing, or simply a keyword. As far as the lack of titanium, that will be a tough sell simply because the shape of Losi's steel turnbuckles mimic the Lunsford made titanium pieces of yesteryear. When I got my SCT RTR, I mistakenly took them for titanium until I got a magnet to them.

Seems kinda odd to have two separate websites for one company, but in a way it isn't simply because one site is for the toys and the other is for the competition vehicles.

If you decide to pursue the seller on the truck, be ready to ship it complete back to him (most likely on your dime) as companies (like the CC company or Paypal) have no way (or desire) to set a "value" on the difference of price between the stock steel and aftermarket titanium pieces. Either action would also just create many more potential problems with the transaction.

I've had to open a few disputes as a buyer with both Paypal and Ebay. So far, all have ruled in my favor as I truly was not at fault for any of these issues. Never had any as a seller.

Looks like I can't file a dispute claim with Paypal because I've already done so through ebay. I guess that answers my question earlier about ebay and Paypal being the same company. :roll: It appears my final recourse is to discuss this with my bank and hope that my account has some form of fraud protection.

But to be honest, that rather lets the wind out of my sails. Part of my desire to pursue this is to be a thorn in the seller's side so maybe next time he reconsiders his misleading selling practices (it's a hobby shop of some sort in Fort Myers, FL). Knowing that he will get off scott free makes me much less enthused about pursuing this because, frankly, it's not even about the money to me.

Don't get me wrong. I'd like to get the $50 or so that I feel would make this right, but that's not my motivation.
