Default Specific tuber rules clarification

I was wondering, in the rules it says a tubers min height has to be 3.75in. Does that mean from the bottom of the tubing to the top, or is it from anywhere level to the bottom to anywhere level to the top. I dont know if i explained this question well enough, so i made a crude paint drawing to illustrate my point.

From the bottom of this "tuber" to the top would be 3in, but if sitting on the ground, the highest point is 3.75. Would a design like this be legal? I have a feeling it would be, but before i build the cab, i wanted to make sure.

I don't know about the rules, but that chassis is 3.5" tall. Just the same as your height is measure from your toes to your head; not your shoulder.
