IMO, since it's part HER house also, she should be allowed to smoke in HER room with the door closed, and maybe a window cracked.
Personally, I think the studies behind 2nd hand smoke, are bias junk science, just like the global warming studies.
Millions of kids have been brought up with smoking parents in the past, they all don't have asthma. I also know friends with a daughter that has asthma, and she's never been around smokers in her life.
Like I stated before, I'd be more worried about her starting a fire. Beyond that, IMO, I think it's cruel to take cigarette's away from a dying old lady.
Contrary to what many might say, the statewide smoking ban in Mn, is hurting bar/rest business, since most bar patrons are smokers anyway. The only bars/restaurants it might not affect much, are the yuppy restaurants, and gay bars
