I'd say you are clear.
I had a similar issue with the buggy I sold over the summer. I specifically told the guy if he wanted to run longer than a 6 minute race he would have to change the gearing in the car. I was running it on a dirt oval, 4-minute heats and a 5 minute main. I could run 6 minutes in practice before the motor would get close to 160 degrees.
First weekend out the guy lets his kid run it around the neighborhood, puts a 6500 mah 2s pack in the car, and lets the kid run it to lipo cut-off.
He didn't tell me those details until after I paid to have the motor shipped back to me. Could smell it was hot when I picked up the package in the mail box.
I'd say you are in the clear. You offered and there is something he definately isn't telling you.
